This is a starting draft. Replace the bracketed details and have it reviewed before you rely on it.
These Terms of Service ("Terms") govern your use of Planting Season, operated by [LEGAL ENTITY NAME] [ABN [ABN]] ("we", "us"), including our website and app ("the Service"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
The Service
Planting Season provides regional planting calendars, growing guides, and garden and homestead planning tools. We offer a free tier and paid plans with additional features. We may update, add or remove features over time.
Accounts
Some features need an account or a saved profile. You are responsible for keeping your login details secure and for activity under your account. Tell us promptly if you suspect unauthorised use.
Plans, billing and pricing
Paid plans are billed through Stripe. Monthly and annual plans renew automatically until you cancel; the lifetime plan is a single one-time payment for access for the lifetime of the Service. Prices are shown in the currency for your region (Australian dollars on this site) and include any applicable taxes unless stated. We may change prices for future purchases. Introductory or "founders" pricing is available for a limited time and may rise for new customers; existing customers keep the plan they bought.
Cancellations and refunds
You can cancel a recurring plan at any time, and it will not renew for the next period; you keep access until the end of the period you have paid for. Nothing in these Terms excludes the consumer guarantees under the Australian Consumer Law or equivalent New Zealand law. If the Service is faulty or not as described, you may be entitled to a remedy. Outside those rights, payments are generally non-refundable for change of mind. For any billing concern, please use our contact form.
Acceptable use
You agree not to misuse the Service: no attempting to break, overload, scrape at scale, or reverse-engineer it, no unlawful use, and no infringing others' rights. We may suspend accounts that breach these Terms.
Content and intellectual property
The Service, including its calendars, guides, text, design and code, is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable licence to use it for your own gardening. Content you enter (such as your garden data) remains yours; you grant us the licence needed to store and display it back to you and operate the Service.
Gardening information disclaimer
Our planting times, plant data and growing advice are general guidance based on regional averages. Results vary with your soil, weather, variety and care. We do not guarantee any particular outcome, yield or result, and the Service is not a substitute for professional horticultural, agricultural, veterinary or food-safety advice. You are responsible for decisions you make in your garden and with any produce or livestock.
Limitation of liability
To the extent permitted by law, and subject to the consumer guarantees that cannot be excluded, we are not liable for indirect or consequential loss, or for loss arising from your use of, or reliance on, the Service. Where our liability cannot be excluded but can be limited, it is limited to resupplying the Service or paying the cost of resupply.
Third-party links and services
The Service may link to third-party sites and uses third-party providers (such as Stripe and Google). We are not responsible for their content or practices; their own terms and policies apply.
Changes to these Terms
We may update these Terms from time to time. The "last updated" date shows when they last changed. Continued use after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of [STATE/TERRITORY], Australia, and you submit to the courts of that jurisdiction. If you use the Service from New Zealand or elsewhere, local mandatory consumer laws still apply to you.
